Four downtown this weekend (high). Two in Canal Place III.<\/p>\n<\/div>\n<div><\/div>\n<div>Liquor Guided by state laws <a href=\"http:\/\/www.malegislature.gov\/Laws\/GeneralLaws\/PartI\/TitleXX\/Chapter138\">Ch 138<\/a>.<\/p>\n<\/div>\n<div><\/div>\n<div>Every police officer in the state must act as agent for Alcoholic Beverage Control Commission.<\/p>\n<\/div>\n<div><\/div>\n<div>Amplified music requires a special permit (max 30 permits per year).<\/p>\n<\/div>\n<div><\/div>\n<div>Stacie Hargis: Is that each time?<\/p>\n<\/div>\n<div><\/div>\n<div>Sullivan: Each time. Same with liquor. Maximum of 30 liquor permits per year.<\/p>\n<\/div>\n<div><\/div>\n<div>Captain Jack Webb:<\/p>\n<\/div>\n<div><\/div>\n<div>Delivery of an alcoholic beverage outside of a residence is prima facie evidence of sale. Even giving a beer to a friend is illegal.<\/p>\n<\/div>\n<div><\/div>\n<div>There are private club licenses, restaurant licenses, beer and wine only for package stores and restaurants.<\/p>\n<\/div>\n<div><\/div>\n<div>Mike Daley: Do bars have a full year sound license and how?<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: Full-time Liquor licenses come with a year-round amplified music license. You cannot get an all-encompassing license for just music. This is not the same as an entertainment license.<\/p>\n<\/div>\n<div><\/div>\n<div>Retail spaces being used for other purposes require an accessory use permit from the building department (occupancy restrictions, etc). Galleries are included.<\/p>\n<\/div>\n<div><\/div>\n<div>Dimitrios Booras: Galleries are not adequately covered by these types of licenses.<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: True. They should get an accessory use permit.<\/p>\n<\/div>\n<div><\/div>\n<div>Sullivan: The prima facie evidence statue limits the officers from using discretion. It requires us to break these up.<\/p>\n<\/div>\n<div><\/div>\n<div>You should draft up a request to the license commission about grey areas.<\/p>\n<\/div>\n<div><\/div>\n<div>Kathleen M: Agreed. License commission is reviewing license rules and regulations\u00a0right now. Good timing.<\/p>\n<\/div>\n<div><\/div>\n<div>Ayer Lofts was serving alcohol this weekend, I was worried they were going to get busted.<\/p>\n<\/div>\n<div><\/div>\n<div>Walter Wright: $75 for wine and beer, $150 for full alcohol, one day.<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: The ABCC doesn\u2019t want you drinking outside of your house or a licensed establishment, and a gallery will not get one of those full, limited-number (states determine how many each municipality receives) licenses.<\/p>\n<\/div>\n<div><\/div>\n<div>Mauricio Cordero: What covers caterers?<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: There is a new license to cover this. It is on the part of the caterer.<\/p>\n<\/div>\n<div><\/div>\n<div>Sullivan: Whistler House has used this.<\/p>\n<\/div>\n<div><\/div>\n<div>Sullivan: There are liability issues as well. If somebody drives drunk from your event, you can be responsible.<\/p>\n<\/div>\n<div><\/div>\n<div>Kathleen: Does a gallery need an insurance rider for events?<\/p>\n<\/div>\n<div><\/div>\n<div>Sullivan: Don\u2019t know.<\/p>\n<\/div>\n<div><\/div>\n<div>Kathleen: Is there a requirement from the license commission about insurance?<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: Don\u2019t know<\/p>\n<\/div>\n<div><\/div>\n<div><b>Investigate.<\/p>\n<p><\/b><\/div>\n<div><b><br \/><\/b><\/div>\n<div>Walter: Is there a cost for the sound permit?<\/p>\n<\/div>\n<div><\/div>\n<div>Sullivan: Don\u2019t know<\/p>\n<\/div>\n<div><\/div>\n<div>Mike Daley: How about outdoor music?<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: Don\u2019t know<\/p>\n<\/div>\n<div><\/div>\n<div>Stacie: COOL put together a festival handbook \u2013 should cover the sound permits.<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: Get the accessory use and sound permit and alert the LPD.<\/p>\n<\/div>\n<div><\/div>\n<div><b>Stacie to get handbook to Kathleen. Where did they happen?<\/p>\n<\/div>\n<div><\/div>\n<div>Webb: Yes, but the cameras tend to miss the action. We can\u2019t say which bars are responsible.<\/p>\n<\/div>\n<div><\/div>\n<div>Sullivan: We are usually making arrests in these cases. The number of incidents look like they\u2019re rising, but that has a lot to do with increased enforcement. We have a few problem places and we know who they are. Maybe with a new licensing commission, we\u2019ll have action. We should work on this and the gallery license stuff as well.<\/p>\n<\/div>\n<div><\/div>\n<div>Kathleen: (To gallery owners) Talk to Andy [Brew\u2019d Awakenings] about the Busk Stop rules; the galleries should get something similar for music.
